Franchise Stock Boost Offer

This Franchise Stock Boost Offer is provided subject to the Main Advertising Terms & Conditions, which are incorporated into these Rules by reference.

Terms defined in the Main Advertising Terms & Conditions shall have the same meaning in these Rules provided that, should a term be defined in both the Main Advertising Terms & Conditions and these Rules, the meaning of the term defined in these Rules shall have precedence in relation to these Rules.

    Business Rules ("Rules")

    1. In these Rules, unless the context otherwise requires, the following terms have the following meanings:
    2. “Contracted Stock Level” means the number of advertisements the Qualifying Dealer has contracted for under their Advertising Agreement as at 21st September 2022 (and, if applicable, including any upgrade to the number of contracted advertisements during the Offer Period in accordance with Clause 10 or, if applicable, adjusted to reflect any downgrade in accordance with Clause 12);
    3. “Franchise Stock Boost Offer” means the promotion operated by Auto Trader which will allow Qualifying Dealers to advertise up to double their Contracted Stock Level at no extra charges for 1 month within the Offer Window;
    4. “Offer Period” means the period of one calendar month, starting on the date during the Offer Window on which the Qualifying Dealer signs up to the Franchise Stock Boost Offer, during which period the Qualifying Dealer is live on the Franchise Stock Boost Offer;
    5. “Offer Window” means the period from 1st November 2022 to 30th April 2023 (inclusive), during which a Qualifying Dealer can sign up to the Franchise Stock Boost Offer;
      1. “Qualifying Dealers” means Advertisers who, subject to any other of these Rules:
      2. have been invited by Auto Trader to join the Franchise Stock Boost Offer;
      3. are Franchise car and van dealers only (including in Northern Ireland) and who have an active Advertising Agreement in place with Auto Trader as of 1st November 2022; and
      4. do not, during the Offer Period, benefit from any other offer or discount operated by Auto Trader, other than the Franchise Package Upgrade Offer.
  1. The Franchise Stock Boost Offer is available to Qualifying Dealers who sign-up to the Franchise Stock Boost Offer during the Offer Window, subject to these Rules. A Qualifying Dealer may only sign up to the Franchise Stock Boost Offer once during the Offer Window.
  2. In order for a Qualifying Dealer to participate in the Franchise Stock Boost Offer, all individual retail sites in such Qualifying Dealer's group must comply with these Rules and meet the eligibility criteria set out in these Rules. If any individual site in a Qualifying Dealer's Franchise Group is not eligible for the Franchise Stock Boost Offer in accordance with these Rules (including, without limitation, if they downgrade or cancel their Package or Contracted Stock Level as detailed in Clauses 4 or 5), the Qualifying Dealer will not be able to participate in the Franchise Stock Boost Offer.
    1. If a Qualifying Dealer, who has not yet signed up to the Franchise Stock Boost Offer, downgrades their Package or Contracted Stock Level during the Offer Window, the Qualifying Dealer shall not be eligible to sign up to the Franchise Stock Boost Offer unless or until one of the following events occurs during the Offer Window:
    2. the Qualifying Dealer retracts the cancellation or downgrade within the 30 day notice period for such cancellation or downgrade;
    3. after expiry of the 30 day notice period for the Qualifying Dealer's downgrade of their Package or Contracted Stock Level, the Qualifying Dealer subsequently upgrades their Package or stock level to the original Package or Contracted Stock Level (as applicable); or
    4. expiry of 60 days after the date of the Qualifying Dealer's request to downgrade their Package or Contracted Stock Level.
    5. The Qualifying Dealer shall become eligible to sign up to the Franchise Stock Boost Offer again on the date that the earliest of the above events occurs (provided it occurs during the Offer Window).

  3. If, once a Qualifying Dealer has signed up to the Franchise Stock Boost Offer, the Qualifying Dealer downgrades their Package or Contracted Stock Level during the Offer Period, (subject to Clause 6) such Qualifying Dealer shall no longer qualify for the Franchise Stock Boost Offer from the date on which such downgrade or cancellation becomes effective (i.e. on expiry of the 30 day notice period) and clause 11 will apply.
  4. If the Qualifying Dealer withdraws their cancellation or downgrade before the end of the 30 day notice period for such cancellation or downgrade, then the Franchise Stock Boost Offer will continue to apply to the Qualifying Retailer for the remainder of the Offer Period.
  5. Subject to Clause 8 below, a Qualifying Dealer who no longer qualifies for the Franchise Stock Boost Offer, in accordance with Clause 5 above, may still be eligible for the Franchise Package Upgrade Offer (subject to the applicable Business Rules).
  6. If a Qualifying Dealer signs up to both the Franchise Stock Boost Offer and the Franchise Package Upgrade Offer at the same time and then subsequently cancels or downgrades their Package or Contracted Stock Level, the Qualifying Dealer will become ineligible for both offers and will not be allowed to reactivate them again within the Offer Window (or the offer window for Franchise Package Upgrade Offer, as applicable).
  7. Qualifying Dealers will be responsible for adding any additional vehicles which it becomes entitled to as part of the Franchise Stock Boost Offer either through Portal, AT Connect or via a stock feed.
  8. Qualifying Dealers can upgrade their Contracted Stock Level at any time during the Offer Period and the Franchise Stock Boost Offer will apply to the additional contracted Advertisements once the upgrade has been applied.
  9. Immediately following the end of the Franchise Stock Offer at the end of the Offer Period (or earlier, in accordance with Clause 5, if applicable) the stock amount will revert to the Contract Stock Level.
  10. If a Qualifying Dealer is under-stocking as at 15th September 2022 (e.g. their Contracted Stock Amount is 100 cars, but they have only had 70 cars on their forecourt for the last 6 months), the Qualifying Dealer will have the option of instantly downgrading their stock (without need to give the usual 30 day notice) provided that: (i) they do so before 1st November 2022; and (ii) they apply the amount of their over-spend (e.g. where they downgrade from 100 cars to 70 cars, they apply the spend equivalent of the extra 30 cars) to other Auto Trader offers or Products (including, without limitation, the Franchise Package Upgrade Offer). The Contracted Stock Level will be adjusted in line with the downgrade under this clause.
  11. Qualifying Dealers cannot advertise stock on behalf of a third party.
  12. Qualifying Dealers shall ensure that individual sites within their group who are eligible for the Franchise Stock Boost Offer shall comply with these Rules, and such Qualifying Dealers shall be primarily liable for such individual sites in connection with these Rules.
  13. Communication regarding the Franchise Stock Boost Offer will be via email, Portal and SMS.
  14. A Qualifying Dealer shall not be permitted to participate in the Franchise Stock Boost Offer if, as at 21st September 2022 or other date during the Offer Window when they seek to sign up to the Franchise Package Upgrade Offer, Auto Trader determines the Qualifying Dealer has outstanding late payments in respect of their Advertising Agreement (until such time as such outstanding amounts are paid).
  15. Auto Trader reserves the right to allow or refuse to allow any Qualifying Dealer to participate in the Franchise Stock Boost Offer at any time, at our sole discretion.
  16. Auto Trader reserves the right to make changes to these Rules at any time and shall give you at least 15 days' notice of any such changes in accordance with clause 2.4 of the Main Advertising Terms and Conditions.
  17. Auto Trader reserves the right to amend, modify, remove and/or extend this promotion at any point with immediate effect.
