Bike Package Upgrade Offer

This Bike Package Upgrade Offer is provided subject to the Main Advertising Terms & Conditions, which are incorporated into the Rules by reference.

Terms defined in the Main Advertising Terms & Conditions shall have the same meaning in these Rules provided that, should a term be defined in both the Main Advertising Terms & Conditions and these Rules, the meaning of the term defined in these Rules shall have precedence in relation to the Rules.

Business Rules ("Rules")

1. "Bike Package Upgrade Offer" means the promotion operated by Auto Trader which will allow Qualifying Retailers, who sign up during the Sign-Up Period, to upgrade their existing Package to the next Package level up (being one or two Packages higher than their existing Package) during the Offer Period by paying their current rate for the Package Upgrade for the first two months of the Offer Period and full price for the Package Upgrade for the next two months of the Offer Period;
2. "Offer Period" means the period starting from when the offer is taken up during the Sign-Up Period (but to start no earlier than 1st May 2024) and continuing for a period of four months through until 31st May 2024 at the latest;
3. "Package Upgrade" means the Qualifying Retailer's upgraded Package as a result of the Qualifying Retailer participating in the Bike Package Upgrade Offer;
4. 1. have been invited by Auto Trader to join the Bike Package Upgrade Offer;
  2. are Bike retailers only (including in Northern Ireland), who currently have no other offer or bespoke arrangement with Auto Trader;
  3. are on a Standard, Enhanced or Super Package; and
  4. meet the downgrade criteria at paragraphs 3, 4, 7 and 8 below; and
5. "Sign-Up Period" means the period between 1st May to 31st May 2024 (inclusive).
The bike Package Upgrade Offer is available to Qualifying Retailers who sign-up for the Bike Package Upgrade Offer during the Sign-Up Period, subject to these Rules. If any individual site in a Qualifying Dealer's Bike group is not eligible for the Bike Package Upgrade Offer, this will not affect the eligibility of the Qualifying Retailer’s other sites to participate in the Bike Package Upgrade Offer.
Qualifying Retailers will not be eligible for the bike Package Upgrade Offer if the Qualifying Retailer has given notice to cancel or downgrade its Package on or after a date falling 3 months prior to going live on the bike Package Upgrade Offer (unless such notice to cancel or downgrade has been retracted during this period).4. In respect of any Qualifying Retailers who participate in the bike Package Upgrade Offer, if they give notice at any time after the commencement of the Offer Period to cancel or downgrade their Package Upgrade, they will become ineligible for the Bike Package Upgrade Offer, and any Package Upgrade shall be charged at Auto Trader's standard rate card for the duration of the Offer Period (including retrospectively).
A Qualifying Retailer shall only be entitled to take up the Bike Package Upgrade Offer once during the Sign-up Period.
Qualifying Retailers who participate in the Bike Package Upgrade Offer shall not be entitled to participate in any other stock and/or Package offers during the Offer Period.
Any pending downgrade of stock at the time that a Qualifying takes up the Bike Package Upgrade Offer, or at any time after commencement of the Offer Period, will need to be retracted in order for a Qualifying Retailer to be eligible for the Bike Package Upgrade Offer and (other than where the Qualifying Retailer retracts their pending downgrade of stock) any Package Upgrade shall be charged at Auto Trader's standard rate card for the duration of the Offer Period (including retrospectively).
In respect of any Qualifying Retailers who participate in the Bike Package Upgrade Offer, if, at any time after the commencement of the Offer Period, any other site in the Qualifying Dealer's Bike group gives notice to downgrade its contracted stock, the Qualifying Retailer shall become ineligible for the Bike Package Upgrade Offer and any Package Upgrade shall be charged at Auto Trader's standard rate card for the duration of the Offer Period (including retrospectively).
Participating in the Bike Package Upgrade Offer constitutes a permanent change to the respective Qualifying Retailer's Advertising Agreement, and the bike Package Upgrade Offer is deemed a formal upgrade to the Qualifying Retailer's Package in accordance with Main Advertising Terms and Conditions. Accordingly, and for the avoidance of doubt, the standard downgrade and cancellation notice requirements set out in the Main Advertising Terms and Conditions shall apply following the commencement of the Offer Period, provided that any such notice given by the Qualifying Retailer to downgrade or cancel the Package Upgrade shall not expire any earlier than the end of the Offer Period.
Qualifying Retailers who downgrade their package at the end of the Offer Period (including a reasonable period thereafter, as determined in Auto Trader’s sole discretion), may be excluded from similar offers in the future regarding upgrade of packages, additional stock, products or services or otherwise, or may require prior approval from Auto Trader to participate in such offers.
Qualifying Retailers cannot advertise stock on behalf of a third party.
Qualifying Retailers shall ensure that individual sites within their group who are eligible for the bike Package Upgrade Offer shall comply with these Rules, and such Qualifying Retailers shall be primarily liable for such individual sites in connection with these Rules.
Any associated costs will be detailed via order confirmation and invoice.
Communication regarding the Bike Package Upgrade Offer may be received via email, Portal or from your Account Manager.
Auto Trader reserves the right to allow or refuse to allow any Qualifying Retailer to participate in the Bike Package Upgrade Offer at its sole discretion.
Qualifying Retailers that breach these Rules may be charged Auto Trader's standard rate card for the duration of the Offer Period in respect of any Package Upgrade (including retrospectively).
Auto Trader reserves the right to amend, modify or remove this Bike Package Upgrade Offer at any point with immediate effect.
