1. What happens if the other driver is uninsured? You can make a claim for compensation to cover personal injuries and any 'out of pocket' expenses you may have suffered as a result of the accident. Instead of pursuing a claim directly against the uninsured driver, you can make an application for compensation to the Motor Insurers Bureau (MIB) under the Uninsured Drivers Agreement. The MIB is a government organisation funded by motor insurers and was founded to provide compensation for the victims of uninsured or untraced motorists. Under the Uninsured Drivers Agreement, you can also recover your legal costs from the MIB. You should contact the police as soon as possible, especially if the other driver fails to provide you with their insurance details.
2. What happens if I’m involved in a 'hit and run' accident?
You can claim compensation for your injuries but this will be made under the MIB Untraced Drivers Agreement. You are entitled to claim for property damage as well as personal injury.
It’s essential to contact the police as soon as possible. Personal injuries should be reported within 14 days of the accident and property damage should be reported within five days of the accident.
3. How much will it cost?
Most insurance companies work on a ‘no win, no fee’ basis. This means it won’t cost you anything if you lose the case, but make sure you shop around and look for hidden charges before choosing a company.
